Terms
Last updated 18 October 2026.
Album is operated by WP FOSS LIMITED, a company registered in Kenya, trading as Album. These terms are the agreement between you and us. By buying an album or using one, you accept them.
We are registered with the Office of the Data Protection Commissioner as Data Controller and Data Processor, registration number 507-1539-1BAA.
How we handle personal information is set out in our privacy policy, which is part of this agreement.
You must be 18 or over to buy an album and to be its owner. An album is a company's records, some of them sensitive, and somebody has to be able to enter a binding agreement about them. Where an album is bought for a company or other organisation, "you" in these terms means that organisation, and the person buying confirms they may agree to them on its behalf.
A company album may hold photographs of children, at a company open day for instance, and of colleagues who have died. That is allowed. What is not allowed is an account held by a child, or an album used to collect images of children who have nothing to do with your organisation.
You may invite anybody you choose into your album. You are responsible for who you invite and for what they can see.
An album on business.album.ke: a private place for your company's photographs, the stories behind them, its people and leadership, and the records a company keeps. Only the people you invite can open it.
An album here is sold together with a domain name of your choosing, registered in your name. The endings on offer are shown on the page where you buy. The section below sets out what that means, because a domain name is not like the rest of the service.
Plans and prices are shown on the page where you buy, and that page is the price. Paid yearly, the album runs for twelve months from the day you pay, with no setup fee. Paid monthly, there is a one-off setup fee and then one payment each month. Either way the price covers the album, storage, backups and help for the time paid for.
When your album comes with a domain name, that name is registered in your name, not ours. You are the registrant. We buy it for you through our registrar and we manage it for you while you are with us.
By M-Pesa or by card. M-Pesa payments go to WP FOSS LIMITED, paybill 4005937. Card payments are handled by our payment processor: your card number is entered with them and never reaches us.
Prices are in Kenyan shillings and include any tax that applies. If we ever have to change a price, your existing plan keeps its price until its next renewal, and we tell you at least 30 days before that renewal.
There is no offer price and no discount code: the first year costs what each later year costs.
If a payment fails, nothing happens immediately. We write to you, and the album keeps working for the grace period below.
Nothing is ever switched off without telling you first, several times. This is exactly what our system does, not a description of what it might do.
| Paid yearly | Paid monthly |
|---|---|
| We email you 30 days before the renewal date, again 7 days before, and again the day before. | We email you 3 days before each payment, and on the day. |
| If you do not renew, the album keeps working for 30 days after the date, and we write to you twice more in that time. | If a payment is missed, the album keeps working for 7 days, and we write to you again 3 days after. |
After the grace period the album is made private. Nobody, including you, can open it until it is paid for. Nothing is deleted. Every photograph, story and name stays exactly where you left it, and paying brings the whole album back the same day, at the same address.
While it is private, its address shows a page saying so, with a button to renew. If you want a copy of your photographs before you decide, write to us and we will give you one. The best time to take a copy is while the album is working: Settings will give you a copy at full quality, whenever you like, as set out under "Your photographs and stories stay yours" below.
How long we hold a private album. We keep it for 12 months. If it is still unpaid then, we write to the owner one last time, and if we do not hear back within 30 days after that, we delete the album and its photographs. We would rather hold your memories than delete them, but we cannot hold them for ever and it is fairer to say for how long.
You can cancel at any time. An owner opens Settings in the album and presses Cancel my album, or writes to us. Nothing is ever taken from you automatically, so cancelling stops the renewal reminders. It does not end the time you have already paid for: the album stays open until then and afterwards closes as described above. You can change your mind until that date, in Settings or by paying again.
If Album does not work as described, tell us within 14 days of paying and we will refund you in full. After that, we do not refund time already used, but we will always look at a genuine problem.
Where a domain name has already been registered for you, the registration fee is not part of the refund, because it has been paid to the registry. You keep the name.
Everything you put into your album is yours. We claim no ownership of it, we do not use it to advertise, we do not sell it, and we do not use it to train anything.
You give us only the permission we need to run the service for you: to store your files, to make the copies and backups that keep them safe, and to show them to the people you have invited.
You can download a copy of your company records at any time, from Settings. You get one zip file with your photographs at full quality, a spreadsheet of their captions, dates and the people in them, your stories and tribute, your company documents and your timeline. It does not hold the list of your people and leadership, the list of your videos and the list of members. Write to us if you want those and we will send them. You do not need our help and you do not need to ask for the zip. You can take it three times a day.
Videos stay on YouTube. A video you add to an album is not stored by us. It stays on the YouTube account of the person who put it there, and we keep only the link. So a video is not in our backups and not in the download, and YouTube's own terms apply to it.
Use Album for your company's own records. Do not use it to store or share anything unlawful, anything that infringes somebody else's rights, or material involving the abuse of children. Do not try to break into anybody else's album, and do not attack the service.
Be thoughtful about other people. An album usually holds photographs of colleagues who never agreed to anything. If somebody asks you to take an image of them down, take it seriously.
If we are told that something in an album is unlawful, we will look into it. We may remove that item or, if we have to, suspend the album. We tell the owner what we did and why, unless the law stops us, and they can ask us to look again.
Album can hold confidential documents in a private section, and can keep them sealed until the album's owners ask for them to be released. This is a way for a company to find what it needs when it needs it. It is not a legal service.
We do not draft, witness, execute or store the official copy of anything. A document in Album is a copy of a document that must be valid in its own right under Kenyan law. Take legal advice about the document itself. We are not responsible for whether it is valid or for how it is interpreted.
A release follows the waiting period and the approvals the owner set up, and every release is recorded.
We work to keep Album available at all times, and we back up every album nightly. We do not promise that it will never be unavailable: no honest service does. Maintenance is done at quiet hours where we can.
Backups are for putting things right after a failure on our side. They are not a substitute for your own copy, and we encourage every company to download their album, or connect their own Google Drive, so that a copy exists somewhere we do not control. Videos are the one thing our backups do not hold: they stay on YouTube, as set out above.
We are not responsible for failures caused by things outside our control, including network or power failures, the acts of another company we depend on, or the registry's own decisions about a domain name.
Some companies reach Album through somebody else: a partner who sells Album as their own product, a reseller, or somebody who recommended us and is paid a share. They are independent. They are not our employees, our agents or our representatives, and they cannot make promises on our behalf.
If you sell Album yourself, or want to, the sections headed "If you sell Album, or send customers to it" and "Selling Album" are for you.
These terms are between you and WP FOSS LIMITED, trading as Album, a company registered in Kenya at Laiboni Centre, 4th Floor, Nairobi, Kenya. They apply if you introduce customers to Album, resell it, or sell it as your own product.
You can apply at album.ke/sell. These terms start when we approve you and give you a link and a code, and they replace anything said before in conversation.
You are an independent contractor. You are not our employee, our agent, our partner in law, or our representative. Nothing here creates a partnership or a joint venture between us.
Your share is the percentage we approved you at, or agreed with you in writing, of what the customer actually pays us, excluding tax and excluding any domain registration fee we pay on to a registry. It applies to the first payment and to renewals, for as long as that customer keeps paying, unless your own agreement says otherwise.
Paid monthly, after a hold of 30 days. A month's sales are paid 30 days after that month ends, which is about the end of the following month. The hold exists because a customer can ask for a refund within 14 days, and because a payment can be reversed after it appears to have cleared. We would rather wait than take money back from you.
A customer is yours if either of these is true, and we will always tell you which:
Say this to yourself before you start. Somebody who hears about Album from you, then types our address directly without your link and without your code, is not attributed to you. There is no way for us to know they were yours. That is why the code belongs in every video description and every post.
If a customer arrives with a code and a cookie from two different people, the code wins: it is the more deliberate act. If two of you have a genuine claim to the same customer, tell us and we will look at what the records show.
We show you our own figures for how often your link was opened, day by day, and we encourage you to publish it through a counter of your own and compare. A shortener counts requests we leave out, such as search engines and link previews, so its figure usually reads a little higher than ours.
You can see, for your own customers only: their family or album name, the email address and telephone number they gave when buying, their plan, whether they have paid, and when they renew. You can never open their album or see their photographs, their stories, their family tree or their private sections.
Those details are given to you to support that customer and for nothing else. You must not add them to a marketing list, sell them, pass them on, or use them for another product. You must keep them safe and delete them if we ask, or if the customer asks. Kenyan data protection law applies to you as well as to us.
You may stop at any time, as above. We may suspend or end an album if it is not paid for, if these terms are broken seriously or repeatedly, or if the law requires it. Except where the law prevents us, we tell you first and give you a fair chance to put it right and to export your photographs.
If we ever stop offering Album, we will give at least 90 days' notice, make it possible to download every album in full, and refund the unused part of what you have paid.
We are responsible to you for losses we cause by failing to take reasonable care. Where the law allows us to limit that, our total liability for any claim is limited to what you have paid us in the twelve months before it arose.
We are not liable for losses that were not foreseeable, for business losses, or for loss of data where you had the means to keep your own copy and did not. We do not limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not let us limit.
We may change these terms. If a change matters to you, we will tell you by email at least 30 days before it takes effect, and you may cancel and be refunded for the unused time if you do not accept it. Small corrections take effect when published, and the date at the top of this page always says when it last changed.

These terms are governed by the laws of Kenya.
If something goes wrong, write to us first at hello@album.ke. Almost everything is settled that way. If it is not, we will try in good faith to agree a solution within 30 days, and failing that the matter goes to arbitration in Nairobi under the Arbitration Act 1995, before a single arbitrator. Nothing here stops either of us from asking a court for an urgent order, or stops you from complaining to the Office of the Data Protection Commissioner.
